9th Circuit Opinion

The U.S. Court of Appeals for the Ninth Circuit heard oral arguments in Powers v McDonough on April 8, 2025. The appeal came after a landmark District Court ruling in favor of homeless veteran plaintiffs ordering VA to build 1,800 units of permanent housing, 750 transitional beds and invalidated leases with third-parties at its historic 388-acre West Los Angeles Medical Center.

The Ninth Circuit published its opinion on December 23, 2025. The panel affirmed in part, reversed in part, vacated in part and remanded the case back to the District Court. Click the button below to read the Ninth Circuit’s published opinion.
